Terms of Service

1. Agreeing to these terms

By creating an account or using myshiftsync.com and its apps (the “Service”), you agree to these Terms and our Privacy Policy. If you don't agree, please don't use the Service. You must be 18 or older.

2. Important: not medical advice, not fitness-for-duty clearance

ShiftSync is a sleep and rest planning aid. It is not a medical device, and it does not provide medical advice, diagnosis, or treatment.

• Fatigue and alertness scores, 72-hour charts, circadian clock views, and timeline suggestions (caffeine cutoffs, light exposure, blue-blocker and melatonin timing) are general estimates based on what you enter and on widely used sleep-science principles. They may be wrong for you.
• ShiftSync does not decide whether you are fit to work, drive, fly, operate equipment, or care for patients. Always follow your employer's and agency's fatigue-risk policies, duty-hour rules, and regulations. Use your own judgment. If you feel too tired to work or drive safely, don't.
• Talk to a qualified healthcare professional before starting supplements such as melatonin or any medication, and if you have ongoing sleep problems, extreme sleepiness, or symptoms of a sleep disorder (for example loud snoring, gasping, or falling asleep at the wheel). This is especially important if you are pregnant, take other medications, or have a health condition.
• Sleep guides are for general education only. They don't replace care from your own clinician.
• In an emergency, call 911.

3. Your account

• Sign in with your email and password, or with a one-time email link we send you. Keep your email account secure, because anyone with access to it can sign in to ShiftSync as you.
• You're responsible for activity on your account. Tell us right away at hello@myshiftsync.com if you think someone has accessed it without permission.
• Give us accurate information. Your plan is only as good as the schedule and inputs you enter.

4. Plans and pricing

• ShiftSync is a subscription service — there is no free plan. Using the full planner and the full calculator results requires ShiftSync Plus, which starts with a 7-day free trial (see section 5). Tonight's 3-step plan on each calculator is available without a card.
• ShiftSync Plus: the full planner and calculators, unlimited schedules, sleep logging, and calendar export (.ics). It costs $9.99 per month or $79 per year. The annual plan is about 34% cheaper than paying monthly for 12 months.
• Prices are in US dollars and don't include applicable taxes. We may change features or prices. If a price change affects you, we'll give you at least 30 days' notice before it applies to your next renewal.
• Features marked “coming soon” (such as Apple Watch auto-sync, SMS reminders, family calendar sync, and the overtime simulator) aren't promised by any date. Don't buy a plan just because of them.

5. Free trial, auto-renewal, and cancellation

• Free trial: new Plus subscribers get a 7-day free trial. A payment method is required to start the trial. At sign-up we'll clearly show the price and the date your first charge will happen. Unless you cancel before the trial ends, your subscription starts and your payment method is charged automatically. One trial per person.
• Auto-renewal: Plus renews automatically at the end of each monthly or annual period at the price in effect at that time, until you cancel. By subscribing, you authorize us (or our payment processor) to charge your payment method each period.
• How to cancel: cancel anytime from Profile → Subscription → Manage or cancel, or email hello@myshiftsync.com and we'll cancel it for you.
• What happens when you cancel: you keep Plus until the end of the period you've already paid for. After that, your access to the planner and calculators pauses. Your schedules and data are kept, not deleted, and unlock again if you resubscribe.
• Refunds: except where the law requires otherwise, payments are non-refundable and we don't give credit for partial periods. App-store purchases follow that store's refund rules.

6. Acceptable use

Please don't:

• Enter patient information, protected health information about other people, or anyone else's private data.
• Misuse, hack, scrape, overload, or reverse engineer the Service.
• Resell the Service or use it to build a competing product.
• Use the Service to break any law or anyone's rights.
• We may suspend or close accounts that break these rules.

7. Your content

You own the schedules and inputs you add. You give us a limited license to store and process them only to run and improve the Service, as described in the Privacy Policy. You can export or delete your data at any time.

8. Our content

ShiftSync's software, design, guides, and brand belong to us or our licensors. You may use them only to use the Service for yourself.

9. Third-party services

Some features rely on other companies, such as Apple Health and Apple Watch (coming soon), calendar apps, SMS carriers, and payment processors. Their own terms apply, and we aren't responsible for how they work.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DON'T PROMISE THAT THE SERVICE WILL BE ACCURATE, UNINTERRUPTED, OR ERROR-FREE, OR THAT IT WILL IMPROVE YOUR SLEEP, ALERTNESS, OR SAFETY.

11. Limitation of liability

TO THE EXTENT THE LAW ALLOWS, SHIFTSYNC (OPERATED BY SYMONE GATES) WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA. THIS INCLUDES HARM ARISING FROM DECISIONS ABOUT WORKING, DRIVING, OR SLEEPING THAT YOU MAKE BASED ON THE SERVICE. OUR TOTAL LIABILITY IS LIMITED TO THE GREATER OF WHAT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR $50. Some states don't allow these limits, so they may not fully apply to you.

12. Indemnity

If you misuse the Service or break these Terms and someone makes a claim against us as a result, you agree to cover our reasonable costs, to the extent the law allows.

13. Ending your account

You can delete your account at any time. We may suspend or end access if you break these Terms or if we stop offering the Service. If we shut down the Service, we'll give you reasonable notice and a prorated refund for any prepaid time you haven't used.

14. Disputes

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Before filing a claim, please email hello@myshiftsync.com so we can try to resolve the problem informally within 30 days. Any dispute not resolved informally will be handled by the state or federal courts located in Texas.

15. Changes to these Terms

We may update these Terms. If we make material changes, we'll give you notice by email or in the app at least 14 days before they take effect. If you keep using the Service after that, you accept the new Terms.

16. Other legal terms

These Terms and the Privacy Policy are the whole agreement between you and us. If any part of these Terms can't be enforced, the rest still applies. If we don't enforce a term right away, we haven't given up the right to enforce it later. You can't transfer these Terms to anyone else without our consent.
